This guide concerns the law and procedures of Türkiye.

Short answer

A removal decision and a decision to hold someone in a removal centre are separate measures. Because a removal challenge has a seven-day filing period, the full decision and its service record should be examined promptly.

Identify the decision you received

A file may contain a residence refusal, entry ban, removal decision and detention decision. Calling all of these “deportation” does not identify the correct remedy. Read the date, reasons, issuing authority and notification record together. If the decision or available remedy is not understood, the need for interpretation and legal assistance should be raised without delay.

The seven-day filing period and notice to the authority

Article 53 of Law No. 6458 allows the foreign national, legal representative or lawyer to apply to the administrative court within seven days of service. The issuing authority must also be informed of the court application. Calculate the final date from the actual notification and file, rather than an online example. Do not assume that every petition submitted to the administration suspends this special filing period.

What court proceedings do and do not change

Subject to the person’s consent, the law prevents removal during the filing period and, where proceedings are brought, until they conclude. This does not mean that the case has been won or that a new residence permit has been issued. Release from administrative detention is a separate question, reviewed by the criminal judgeship of peace (sulh ceza hâkimliği). Keep proof of filing and of informing the administration.

Explain return risks through individual circumstances

Non-refoulement and situations in which a removal decision must not be issued require an assessment of the individual and the destination country. Health, family ties, earlier protection applications and evidence of specific threats may matter. Explain how general country information relates to the person’s own experiences. No single document guarantees an outcome. This guide explains Turkish procedure; individual deadlines and remedies require examination of the file.
