This guide concerns the law and procedures of Türkiye.
Short answer
Administrative detention in a removal centre is not a criminal conviction. The basis for detention, its continuing necessity and any removal decision need separate examination; their remedies are not interchangeable.
Obtain the written basis for detention
Start with copies of the detention decision, any removal decision and their service records. Decisions about the same person are not necessarily the same measure. Examine the stated reasons alongside identity, address, family circumstances and earlier applications. Article 68 provides a different detention regime for international-protection applicants, so the same conditions and periods cannot be applied to every file.
Detention review differs from a removal case
The person, legal representative or lawyer may challenge detention before the criminal judgeship of peace (sulh ceza hâkimliği). Filing does not automatically suspend detention. The statutory five days concerns the judge’s examination, not a five-day filing deadline for the detainee. A further application may be made where detention conditions have changed or ceased. This route does not replace the separate seven-day administrative court period for a removal decision.
Duration, monthly review and alternatives
Detention pending removal under Article 57 has a six-month upper limit. A further period of up to six months may be considered where removal cannot be completed because the person does not cooperate or provide correct information or documents; this is not automatic twelve-month detention. Continuing necessity is reviewed monthly, or earlier when needed. Alternatives such as residence at a specified address and reporting obligations require individual assessment.
Contact, health and legal assistance
Access to a lawyer, legal representative, notary and relatives, together with telephone access, forms part of the statutory safeguards. Health and special needs should be clearly reported to the relevant unit, with available medical records. People unable to pay for legal assistance can seek information about legal-aid conditions; an application and assessment are required. Check current visiting arrangements through official channels and keep decisions and applications in date order.

Frequently asked questions
Does my right to challenge detention expire after five days?
The five days refers to the judge’s examination. However, the separate seven-day period for challenging removal must not be overlooked.
Does release from detention give me a residence permit?
No. Ending detention is different from a right of residence or cancellation of a removal decision; those matters need separate assessment.
