This guide concerns the law and procedures of Türkiye.

Short answer

A mandatory pre-litigation mediation framework applies to tenancy disputes; the exception concerning eviction through non-judgment enforcement requires separate assessment. The appropriate procedure depends on the claim.

First identify the dispute

“We cannot agree with the tenant” is not specific enough to prepare an application. Are you claiming unpaid rent, disputing the rent level or seeking eviction? A single tenancy can involve several legal issues. The basis of each claim must be identified separately.

The Ministry of Justice explains that mandatory mediation for tenancy disputes took effect on 1 September 2023. The exception for eviction through non-judgment enforcement and the actual nature of the dispute must still be considered. Not every tenancy-related procedure follows the same sequence.

Bring more than a figure to the table

Prepare the lease, payment history and any notices together. Where a claim covers particular periods, listing those periods separately clarifies the disagreement. If payment is alleged, matching records to their dates is also useful.

When considering settlement, review due dates, instalments, handover terms and what will happen to existing proceedings. Agreement on a total amount alone may not resolve every practical issue.

The settlement document is more than meeting minutes

Check that points discussed at the meeting actually appear in the document. Unclear descriptions of premises, payment accounts or deadlines remain unclear after signing. Assessment requires reading the settlement’s scope and legal effects.

Confidentiality and evidentiary-use rules apply to information and documents in mediation. Not every statement made in the process can be assumed directly usable as evidence in later proceedings. Pre-existing documents and statements arising during negotiations are treated differently.

Frequently asked questions

Does every tenancy matter follow the same mediation rule?

No. The nature of the dispute and statutory exceptions, particularly eviction through non-judgment enforcement, require examination.

Does the mediator decide for either party?

Mediation helps parties develop a solution. A mediator does not deliver a judgment like a judge.
