Short answer
Agreement to divorce is not enough by itself. In addition to statutory requirements, suitable arrangements for the financial consequences and the children are needed; the judge hears the parties in person.
Fitting on one page does not make a settlement complete
“We have no claims against each other” sounds short and decisive. But if the subject of the agreement, the payment dates or excluded claims are unclear, the document may start a new dispute. A settlement should not be treated as an online form with blanks to fill in.
Article 166/3 of the Turkish Civil Code includes requirements such as a marriage lasting at least one year and the judge personally hearing the parties’ intentions. The arrangements for financial consequences and children must also be found suitable. A signed agreement does not remove the court’s scrutiny.
Children’s daily lives belong in the agreement
Contact arrangements involve more than choosing a day of the week. School and healthcare routines, handover times, holidays and the parents’ living conditions must be considered together. An arrangement convenient for the adults may not work for the child.
How maintenance and education or healthcare costs will be addressed should also be clear. Regulating the same expense differently in two clauses can make the document difficult to interpret later. The child’s interests should be considered separately from bargaining between the parties.
Read payment and property provisions separately
A payment’s due date, method and the claim it settles matter as much as its amount. The treatment of matrimonial property claims also needs specific review. Divorce, transfer of land and delivery of belongings may be subject to different legal requirements.
Before the consultation, it helps to list your expectations under separate headings: children’s arrangements, regular payments, one-off payments and property transactions. If a point remains disputed, do not conceal it within a general waiver.
